Plain-language purchase terms.
Takeoff Field Tools is the product and support brand. Legal seller pending launch approval is the legal Supplier for these terms once paid sales open; the same name must appear consistently here, at checkout, and on the receipt. Payments, tax collection, receipts, and refunds are processed by Lemon Squeezy as merchant of record. Questions can be sent through the support address.
End-user license
This agreement is between the supplier identified on your purchase receipt (the “Supplier”) and the person or business that acquires Takeoff (the “Customer”). By downloading, installing, or using Takeoff, the Customer agrees to these terms.
License grant
The Supplier grants the Customer a non-exclusive, non-transferable license to install and use the purchased major version of Takeoff for commercial or personal construction work. A single-user license may be used by one named person on up to two Windows computers controlled by that person.
Updates and ownership
The purchase includes fixes and feature updates released for Takeoff version 1. A later major version may require a separate paid upgrade. The Customer owns their project files and exported work product. The Supplier retains ownership of the software, brand, and documentation.
Restrictions
The Customer may not resell, sublicense, publicly distribute, or provide shared access to the software package or license credentials; remove proprietary notices; or use the software to violate law or third-party rights. Normal backups and internal deployment copies are allowed.
Customer responsibility
Construction quantities, prices, schedules, bids, and exports require professional review. The Customer is responsible for calibrations, source documents, cost data, formulas, assumptions, backups, and final work product. Takeoff does not provide engineering, architectural, legal, tax, or financial advice.
Warranty disclaimer and liability
Except for the refund promise below and rights that cannot legally be excluded, the software is provided “as is” and without implied warranties. To the maximum extent permitted by law, the Supplier is not liable for indirect, incidental, special, or consequential loss. The Supplier’s aggregate liability for a claim related to the software will not exceed the amount the Customer paid for the license.
Termination
The license ends if the Customer materially breaches these terms and does not cure the breach after notice where a cure is possible. On termination, the Customer must stop using and delete the software. Project exports remain the Customer’s property.
Privacy
Local project data
Takeoff is local-first. The application stores drawings, estimates, project records, backups, and audit information on the Customer’s computer. The founding version does not operate a Takeoff cloud service and does not automatically upload project contents to the Supplier.
Takeoff does not add application-level encryption to local project files. Customers handling sensitive plans should use Windows device encryption or BitLocker, a protected Windows account, and encrypted backups appropriate to their organization.
Purchase data
The checkout provider processes customer identity, billing, payment, tax, fraud-prevention, and transaction information under its own privacy terms. The Supplier receives the order and contact information needed to deliver the product, validate the purchase, prevent abuse, issue updates, and provide support. The Supplier does not receive full payment-card details.
Website and support data
The launch website does not require advertising cookies. Basic hosting logs and campaign parameters may be processed to measure traffic and purchases. A visitor who explicitly joins the launch list receives a confirmation email before the address, signup time, landing page, and available campaign attribution are retained for launch and occasional product updates. Marketing messages provide an unsubscribe mechanism. If a Customer requests support, the Supplier processes the information the Customer chooses to send. The built-in support bundle is designed to redact project content, drawings, and financial details, but the Customer should review any file before sending it.
Retention and rights
Order records are retained as needed for licensing, refunds, accounting, fraud prevention, and legal obligations. Support records are retained only as long as reasonably necessary. Customers may request access, correction, or deletion subject to records the Supplier must keep by law. Privacy and deletion requests can be sent through the support address.
30-day refund policy
A Customer may request a refund within 30 calendar days after the original purchase. The request should include the order email address and order number. The Supplier or merchant of record may ask for enough information to locate the order and prevent duplicate refunds.
Once a refund is issued, the license ends and the Customer must stop using and delete the software. This policy does not limit mandatory consumer rights. Refunds are returned through the original payment method and may take additional banking time to appear.
